David Russell Smith Presents at 34th Annual Georgia Insurance Law Institute

David Russell Smith presented two papers at the 34th Annual Insurance Law Institute at St. Simons Island, Georgia on September 18, 2015. The first paper, entitled “Recent Developments in Georgia Reservation of Rights Law,” reviewed several recent Georgia cases emphasizing that liability carriers in Georgia must fairly and unambiguously inform their insureds of coverage issues when defending them under a reservation of rights. The second paper, entitled “Is There a Duty to Split the Claim File When Defending under a Reservation of Rights,” discussed the scarcity of case law on the common practice of liability carriers splitting their claim files when defending an insured under a reservation of rights. The Insurance Law Institute is sponsored by the Institute of Continuing Legal Education in Georgia and the Tort and Insurance Practice section of the State Bar of Georgia. It was well attended by tort and insurance lawyers from across the state.
