Greg Veal presented his paper, “Going Nuclear: Rescinding Fidelity and Financial Institution Bonds,” to the annual fall conference of the ABA Fidelity & Surety Law Committee in Hartford, Connecticut on November 8, 2012. As has been the case for years, this conference was the nation’s largest gathering of professionals interested in fidelity bonds. Speaking with Greg was Dolores Parr of Zurich North America. They discussed the issues affecting the ability to rescind a bond when the insured has misrepresented facts material to the underwriting process, including special rules regarding the FDIC, and the legal, practical, and business considerations when deciding whether or not to rescind.
