Kim M. Jackson and Jared W. Heald prevail on OCGA 9-11-68 Motion for Fees Following Successful Trial Verdict

Rome, Georgia’s largest CPA firm at trial in March. Following the trial, Kim M. Jackson and Jared W. Heald moved for attorney fees and expenses associated with defending the second trial based on the failure of Plaintiff to recover at least 75% of a pre-trial offer, as permitted by OCGA 9-11-68. The Plaintiffs opposed the motion arguing that the offer of settlement had been made in bad faith. The Court held a hearing in May of 2015, and issued its written order in December of 2015, granting the CPA firm’s motion and awarding over $100,000 in attorney fees and expenses.
