Summary Judgment Victory in Wrongful Death Case

Steve Kyle and Billy Davis prevailed on a motion for summary judgment filed in the State Court of Bibb County in a wrongful death action involving premises liability at a gymnastics facility. The plaintiff was injured in a fall from a set of bleachers in an observation area on the property. The motion for summary judgment focused on the lack of evidence establishing any unreasonably dangerous condition which caused the fall. Additionally, the motion presented argument that any alleged defect with the bleachers was “open and obvious” and thus could not give rise to a cause of action under Georgia law.
