Summary Judgment Won on Behalf of National Janitorial Services Company in Premises Liability Case

Billy Davis won summary judgment for a national janitorial services company in a premises liability action filed in Cobb County.
Two employees of a bank call center were injured when they separately slipped and fell on ice that had accumulated in the parking lot of the call center. The employees sued the owner of the call center property as well as two contractors who held a contract to perform certain facilities maintenance services at the center. The Plaintiffs alleged that the owner and contractors owed a duty to warn them of the dangerous conditions and/or to remove the ice.
The judge agreed with the position asserted in Davis’ motion, noting that the janitorial services company had properly tendered the ice-removal work to an independent subcontractor. Because an independent contractor performed the work, there was no legal basis for liability on the part of the janitorial services company.
